$1 Billion Bowdens Silver Mine Faces Renewed Scrutiny Over Environmental Risks

The proposed $1 billion Bowdens silver mine near Mudgee in Central West New South Wales is undergoing a fresh assessment after a court overturned its original approval. Community opposition has intensified, with residents staging a tractor protest over concerns about lead contamination, water quality and the potential impact on nearby farms.

Silver Mines Limited is seeking approval to extract 30 million tonnes of ore over 23 years. The Independent Planning Commission (IPC) has begun three days of hearings, with a newly appointed panel responsible for making a fresh determination.

Environmental Concerns Remain Central to the Review

Residents have raised concerns about potential lead exposure, contamination of Lawson Creek and risks to livestock. The company previously offered voluntary blood testing for residents, particularly children at Lue Public School, approximately two kilometres from the proposed mine.

Local resident Janet Walk questioned whether monitoring would prevent exposure, while farmers expressed concern about the consequences of contamination for agricultural operations. Susannah White, whose beef farm lies downstream from the proposed site, warned that livestock exceeding applicable lead limits could become unsaleable, potentially threatening her business.

These concerns have become central to the assessment, alongside the project's proposed economic benefits.

Why the Original Mine Approval Was Overturned

The IPC originally approved the project in April 2023, but the decision was successfully challenged by the Bingman Catchment Landcare Group. In August 2024, the NSW Court of Appeal ruled that the commission had failed to consider the environmental impacts of a proposed 13-kilometre transmission line, rendering the approval void.

The state government subsequently introduced legislative changes allowing certain off-site infrastructure for major projects to be assessed separately. However, Bowdens still requires a new determination. The current panel has confirmed that the previous approval will have no influence on its assessment.

Mining Proponent Highlights Strategic Benefits

Silver Mines Limited managing director Jo Battershill told the hearing that the project’s merits were stronger than when it was initially approved. He argued that the development could support regional economic activity, advance the state's strategic minerals objectives and contribute to the global renewable energy transition.

The company has also provided additional advice, including biodiversity and climate change assessments. A supplementary report from the NSW planning department concluded that the project's benefits outweighed its residual costs and that it was in the public interest and capable of approval.

However, opposition remains significant, with 97 speakers scheduled to provide evidence during the three-day hearing. The IPC must weigh the project's potential economic and strategic benefits against environmental concerns and possible effects on farming businesses before reaching its decision.

What Investors Should Watch Next

The IPC’s fresh determination will be a key development for Silver Mines Limited, as the Bowdens project remains subject to planning approval.
